The maintenance obligation constitutes the obligation to help a member of one’s family if they are no longer able to meet their needs (food, housing, financing medical care, etc.). This help can be:

in kind (free accommodation or food, for example) material (a pension paid in money, for example)

An ascendant (parent, grandparent, great-grandparent, etc.), who is in need, can claim this maintenance obligation from one of their descendants (child, grandchild, etc.). This obligation also applies to sons-in-law and daughters-in-law towards their in-laws.

This assistance varies according to the needs and resources of the person obliged to provide support, that is to say the person who will finance the needs of their ancestors.

“Aging well” law: removal of the maintenance obligation for certain descendants

The law of April 8, 2024 laying down measures to build the society of aging well and autonomy removes this obligation in certain cases.

Therefore, it no longer applies to:

children who were removed from their family environment before their 18th birthday and for a period of at least 36 cumulative months; children of a parent convicted as perpetrator, co-perpetrator or accomplice of a crime against the other parent; children of a parent convicted as the perpetrator, co-perpetrator or accomplice of sexual assault against the other parent; grandchildren in the frame a request for social assistance for accommodation (ASH) for one of the grandparents.
