WASHINGTON, D.C. Today, Congressman Troy E. Nehls (R-TX-22) released the following statement regarding President Joe Biden’s recently released executive order, which uses Section 212 (f) and Section 215 (a) of the Immigration and Nationality Act (INA) to suspend asylum requests once the daily crossings of illegal aliens top 2,500 between ports of entry. Congressman Nehls previously suggested using 212(f) of the INA in a House Judiciary Subcommittee hearing to suspend all entry of illegal crossings nearly one year ago:

“Last June, during a House Judiciary Subcommittee hearing, I suggested that the Biden Administration use Section 212 (f) of the INA to stop the border crisis, and I was essentially told by the Democrat witness that was impossible,” said Congressman Nehls. “Now, five months away from the 2024 presidential election, Joe Biden is using Section 212 (f) of the INA to ‘secure’ the southern border. Nothing has changed in the last 363 days, except over 2 million more alien encounters and Joe Biden’s disastrous poll numbers. Now that his poll numbers are in the toilet, suddenly, 212(f) is looking pretty good to him and his cronies to trick the American people into believing he cares.

“If Joe Biden really cared, he’d use 212(f) to suspend all illegal crossings until we are able to deport everyone who has entered unlawfully under Joe Biden’s watch. Saying ‘we’ll stop them after 2,500 illegal crossings’ is like saying ‘we’ll start arresting after 2,500 burglaries.’ Give me a break. The American people are smarter than this, Joe.

“Make no mistake, Joe Biden inherited a secure border, all thanks to the successful policies of President Donald Trump. All Joe Biden had to do was keep President Trump’s border policies in place and the American people would be safe today. Instead, Joe Biden took over 60 executive actions that created the absolute chaos we are seeing at our nation’s borders and across our country. Shame on him for this weak attempt to use 212(f) after more than 9.5 million people have crossed our borders since he took office. It’s too little, too late.”


During a House Judiciary Subcommittee hearing on June 7, 2023, Congressman Nehls asked Aaron Reichlin-Melnick, the Policy Director for the American Immigration Council, about Section 212 (f) of the INA, to which Mr. Reichlin-Melnick responded, “Well, 212 (f) in particular is quite complicated because it cannot be applied at the border to turn away asylum seekers.” This is a direct contradiction to the executive order released today.

Almost one year from Mr. Reichlin-Melnick saying this, President Joe Biden has issued an executive order using Section 212 (f) of the INA, which states, “[w]henever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.”

The executive order issued by President Biden also uses Section 215 (a) of the INA, which states that it is “unlawful…for any alien to depart from or enter or attempt to depart from or enter the United States except under such reasonable rules, regulations, and orders, and subject to such limitations and exceptions as the President may prescribe.”
