Following the relaxations decided by the Federal Council on May 26, the Canton of Vaud adopted the necessary measures to authorize and support the organizers of major events in the pilot phase in June and from July 1, 2021 for major events of more than 1000 people. The State Council has set the authorization and compensation procedures in the event of cancellation due to the epidemiological situation, according to the principle of the protection umbrella decided at the federal level.
In accordance with the decisions taken by the Federal Council, the Council of State adopted the framework conditions to allow the organization of major events of more than 1000 people from July 1, 2021. It also authorized the setting up of the two events pilots announced by the organizers, namely the Triathlon de la Vallée de Joux and the Chœur Vivace concert which will take place respectively on June 26 and 27 in La Vallée and on June 17 and 18 at Lausanne Cathedral.
According to the procedure adopted, the organizers of major events must submit their request as soon as possible on the cantonal events portal, POCAMA, but no later than 21 days before the event. The request must contain all the necessary documents, in particular the protection plan and the budget.
To facilitate the work of the organizers, the Cantonal Driving Staff (EMCC) and the Office of the Cantonal Doctor (OMC) have prepared models of a standard protection plan, available on POCAMA. The file will be notified beforehand by the various competent services of the cantonal administration and the municipality concerned and the decision to authorize the event or not will be made by the head of the EMCC, taking into account the epidemiological situation at the time. The head of the EMCC delegates the authority to authorize events to the municipality of Lausanne for all events that are within his sole competence. The protection plans must however be validated beforehand.
Any appeals must be addressed through ordinary law, ie the Administrative and Public Law Court (CDAP) of the Cantonal Court. The monitoring of compliance with the measures put in place by the organizer will be carried out by a dedicated task force, under the guidance of the Cantonal Doctor’s Office, reinforced by the Cantonal Police, under the responsibility of the EMCC.
In addition to and as an implementing measure for art. 11 of the COVID-19 Law, the Federal Council issued a specific ordinance regulating the conditions under which the Confederation and the Canton may decide to participate in the costs of a major event that would be canceled due to the epidemiological situation (protective umbrella) . To do this, it is mandatory to attach the event’s budget to any request. As a reminder, the amount of the guarantee is covered at a rate of 50% by the Canton and 50% by the Confederation. For each event concerned, the organizer must assume a deductible of 5,000 francs on the overdraft and a quota of 10% on the remaining amount. The assumption of costs by the Confederation and the cantons is capped at 5 million francs per event. This regulation will apply for events organized between June 1, 2021 and April 30, 2022.
