Vacant housing rate and official formula for change of tenant

Once again this year, the Council of State will publish by decree in the Official Notice Sheet the list of districts affected by a shortage of vacant housing and by the obligation to notify the official form of the change of tenant. In 2021, only the districts of Eagle and Broye-Vully will not be affected by a vacancy rate of less than 1.5%. Consequently, in these two regions, landlords will no longer be required to notify the official formula approved by the Canton when entering into any new rental lease contract.

According to the law on the preservation and promotion of rental stock (LPPPL), the Council of State must publish by decree at the beginning of each year the list of districts where there is a shortage of vacant housing. Such a situation is decreed when the vacancy rate, calculated on an average of three years, is less than 1.5%. However, a municipality in which the situation of the housing market is significantly different from that of the district may ask the State Council to be removed from the list or be included in it. In 2021, only the districts of Aigle and Broye-Vully, with 2.43% and 2.5% of vacant housing respectively, will not experience a shortage. Consequently, the municipalities of these two districts will no longer be able to use their right of first refusal to acquire land put up for sale in a legalized building zone, with a view to building public utility housing there. In addition, the provisions relating to the preservation of the rental stock provided for in the LPPPL will no longer be applicable in these two districts.

In September 2020, the Grand Council also decided to modify article 4 of the law on the use of an official formula for changing tenants (LFOCL) in order to standardize the definition of the housing shortage with the LPPPL. . In doing so, the vacancy rate for housing is henceforth calculated also at the level of a district and no longer at the level of the canton. This change in law, which comes into force on January 1, 2021, also requires the Government to publish by decree, at the start of each year, the list of districts where donors are or are not required to notify the official formula at the time of the conclusion. any new rental lease agreement, which allows the tenant to contest an abusive initial rent. Next year, this obligation will remain in effect in all districts of the canton except those of Aigle and Broye-Vully which are not in a situation of shortage of vacant housing.
