The German Bundestag concluded the deliberations on the EEG reform 2021 on Thursday. The local political spokesman for the CDU / CSU parliamentary group in the German Bundestag, Christian Haase, explains:

“From a municipal point of view, we expressly welcome the result of the parliamentary deliberations. The communal planning sovereignty is not being undermined, but even strengthened in the case of wind energy. The municipalities in whose area there are wind turbines will in future have a better share in the income from wind energy generation. This means that the main requirements of the Local Policy Group will be implemented in the 2021 EEG reform.

From a municipal point of view, the deletion of the originally intended definition of renewable energies as part of public safety is of great importance. This could have led to considerable problems in terms of building planning law on site, including restrictions on municipal planning law and thus a restriction on local self-government. It is important for the municipalities that they retain the authority to act in terms of planning law and that planning decisions cannot be later weakened.

We also expressly welcome the fact that the motion for a resolution, which has also been submitted for discussion, is intended to improve the framework conditions for accelerating the planning and approval of repowering for wind turbines. With this approach, which also takes up a requirement of the Local Policy Working Group, the local authorities will in future receive more planning security for this important aspect of the expansion of renewable energies. The planned changes should not be limited to repowering systems. The entire wind power planning law must be amended.

With the possibility that the operator of wind energy plants can pay the local authorities 0.2 cents per kilowatt hour annually in the future, we are improving the possibilities of improving the acceptance of wind energy projects on site. During the consultations, it was important to us that, in contrast to the original plan, a fixed amount of 0.2 cents per kilowatt hour was set. Even if the law defines the regulation as “can-do”, the municipalities regularly expect a corresponding offer from the project developer.

At the same time, with the motion for a resolution, we have created the prerequisites for the local municipalities to be better involved in business tax in future. With this aspect, too, which implements a long-pursued deliberation of the local government working group, we can not only improve acceptance but also help to improve the financial situation, especially of local authorities in rural areas. This is an important contribution to the creation of equal living conditions. “

Background: With the motion for a resolution, the German Bundestag calls on the federal government to develop accelerated planning and approval of projects, particularly with a view to repowering

to examine the inclusion of repowering as a principle of spatial planning in Section 2 of the Regional Planning Act,
to examine how obstacles to repowering can be dismantled in building planning law,
to examine further improvements to repowering in the Federal Immission Control Act, e.g. B. in the case of improved framework conditions for change approvals,
to advance the standardization of the species protection requirements as quickly as possible; to examine a reduction in the scope of testing under species protection law with the aim of accelerating the procedure,
to consistently pursue and examine further approaches in the area of ​​planning acceleration: this includes better personnel and technical equipment of the planning and approval authorities as well as service centers for planning and approval authorities and those involved / affected it is also necessary to examine how the abuse of legal standing can be prevented by a closer limitation.

The better financial participation of the local communities will in future be standardized in Section 36k EEG: “Operators of wind turbines on land who are awarded a contract for their system are allowed to grant the communities affected by the construction of the wind turbine a unilateral grant with no consideration in total Offer 0.2 cents per kilowatt hour for the amount of electricity actually fed in and for the fictitious amount of electricity according to Annex 2 number 7.2.

With the motion for a resolution, the German Bundestag calls on the federal government to reform the distribution of the breakdown of trade tax for wind turbines on land, so that the municipalities of wind turbines receive 90 percent of the distribution of the broken down trade tax shares and the municipalities of the operating companies receive 10 percent. The local communities should receive a higher proportion of trade tax for systems for the generation of electricity and other energy sources as well as heat from wind energy and solar radiation energy, which is appropriate to the previous regulation in the trade tax law. This is intended to increase the acceptance of renewable energy projects in the area of ​​the respective municipality, with the aim of approving renewable energy projects better and faster overall. To this end, the trade tax regulations on the breakdown of trade tax must also be adapted.
