1. Resumption of the session

The session suspended on Thursday 26 November 2020 was resumed.


2. Opening of the sitting

The sitting opened at 17.05.


3. Statements by the President

The President made a statement from Strasbourg in which he expressed his solidarity with the people of the city and the French authorities.

The President recalled the terrorist attack on Strasbourg on 11 December 2018 in which a number of people had been killed. He expressed his condolences to the families and friends of the victims.

The President stated that Parliament was keen for its plenary sittings to return to Strasbourg. He pointed out that Parliament had shown its democratic responsibility during the pandemic and had continued to exercise its prerogatives.

The President then paid tribute to the memory of Valéry Giscard d’Estaing, who had died on 2 December 2020, and in whose honour Parliament would hold a formal sitting on 2 February 2021.

Parliament observed a minute’s silence.

The President made a statement in which he emphasised that the EU should continue to spearhead a green transition and highlighted the importance of the Paris Climate Agreement.

He mentioned the important votes that would be held that week, including on the budget and matters relating to the rule of law.

The President recalled that it was the 25th anniversary of the Dayton Peace Agreement and emphasised how important reconciliation in Bosnia-Herzegovina was for future generations.

4. Approval of the minutes of the previous sittings

The minutes of the sittings of 23, 24, 25 and 26 November 2020 were approved.


5. Composition of Parliament

József Szájer had given notice in writing of his resignation as Member of Parliament, with effect from 2 January 2021.

In accordance with Rule 4(1), (2) and (3), Parliament established that Mr Szájer’s seat had fallen vacant on that date and informed the national authority concerned.


6. Request for waiver of immunity

The competent Belgian authorities had forwarded a request for the waiver of Filip De Man’s immunity in order for him to be brought before a police court in connection with a traffic accident.

Pursuant to Rule 9(1), the request had been referred to the committee responsible, the JURI Committee.


7. Composition of political groups

Ignazio Corrao, Rosa D’Amato, Eleonora Evi and Piernicola Pedicini no longer sat with the non-attached Members and had joined the Verts/ALE Group as of 9 December 2020.

9. Announcement by the President

The President informed the House that no objections had been raised within the 24-hour time limit to the joint position of the DEVE Committee and the BUDG Committee on the extension of an EU emergency trust fund for Africa, announced in plenary on Thursday 26 November 2020 (Minutes of 26.11.2020, Item 12).

The joint position had therefore been officially forwarded to the Commission.


10. Negotiations ahead of Parliaments first reading (Rule 71)

The President announced that the LIBE Committee had decided to enter into interinstitutional negotiations under Rule 71 of the Rules of Procedure on the basis of the following reports:

Under Rule 71(2), if, before midnight on the following day, Tuesday 15 December 2020, a request in writing had been received from a number of Members or one or more political groups reaching at least the medium threshold, the decisions to enter into negotiations would be put to the vote.

Negotiations may start at any time after that deadline has expired if no request for a vote in Parliament on the decisions to enter into negotiations has been made.


11. Negotiations ahead of the Council’s first reading (Rule 72)

The President announced that the ENVI and JURI/LIBE committees had decided to enter into interinstitutional negotiations, in accordance with Rule 72, on the basis of Parliament’s following positions at first reading:

In accordance with Rule 111(6) and Rule 112(4)(d), the Chair of the Conference of Committee Chairs had informed the President of Parliament that no objections had been raised in respect of:

– the recommendation of the ENVI Committee to raise no objections to the Commission delegated regulation of 29 October 2020 amending Delegated Regulation (EU) 2019/2124 as regards official controls at the border control post where goods leave the Union and certain provisions on transit and transhipment (C(2020)07418 – 2020/2855(DEA)) (B9-0420/2020);

– the recommendation of the ENVI Committee to raise no objections to the draft Commission regulation amending Annex XIV to Regulation (EC) No 1907/2006 of the European Parliament and of the Council as regards the substance group 4-(1,1,3,3-Tetramethylbutyl)phenol, ethoxylated (covering well-defined substances and substances of unknown or variable composition, complex reaction products or biological materials, polymers and homologues) (D070073/02 – 2020/2898(RPS)) (B9-0408/2020);

– the recommendation of the IMCO Committee to raise no objections to the Commission delegated regulation of 20 November 2020 amending Delegated Regulation (EU) 2015/2446 as regards the time-limits for lodging entry summary declarations and pre-departure declarations in case of transport by sea from and to the United Kingdom of Great Britain and Northern Ireland, the Channel Islands and the Isle of Man (C(2020)08072 – 2020/2890(DEA)) (B9-0417/2020);

– the recommendation of the JURI Committee to raise no objections to the Commission Delegated Regulation of 6 November 2020 amending Delegated Regulation (EU) 2019/815 as regards the 2020 update of the taxonomy laid down in the regulatory technical standards for the single electronic reporting format (C(2020)7523 – 2020/2865(DEA) (B9-0418/2020).

If, within 24 hours of this announcement, no objections had been raised by a political group or Members reaching at least the low threshold, the recommendations would be deemed approved. If objections were raised, they would be put to the vote.

The President informed the House that once they had been adopted by Parliament, he would sign, in accordance with Rule 96, texts relating to the budget as definitively adopted:

– Amending budget No 10/2020 of the European Union for the financial year 2020 – Increase of payment appropriations in line with updated forecasts of expenditure and other adjustments to expenditure and revenue (2020/0298(BUD).

The President also informed the House that, jointly with the presidents of the Council and the Commission, he would sign:
