While acting without a lawyer is sometimes possible, you should be aware of the rules of procedure when choosing to defend yourself before a judge. This is what the Court of Cassation recalls in a judgment of September 23, 2020. Anyone who does not have a lawyer cannot approach justice like a professional.

An owner is expropriated for public utility of the property belonging to him. The court fixes the compensation due to it. The owner appeals and submits his findings electronically.

The conclusions, if they were sent within the time limit, were not validly transmitted. That’s what the appeals court holds. Anyone who does not have a lawyer cannot use the electronic way for such sending. It is a secure mode of transmission reserved for lawyers. The party without a lawyer must contact the judge by registered letter with acknowledgment of receipt.

The Court of Cassation dismisses the appeal. For her, only a legal professional can provide the guarantee of secure electronic exchanges. While legal representation is not compulsory, the party who chooses to do without a lawyer is not entitled to the same means of communication.

Note: since January 1, 2020, the lawyer has become compulsory in this procedure.
