Freedom of contract and cost advantages secured

The federal cabinet launched the law for fair consumer contracts on Wednesday. The legal and consumer policy spokesman for the CDU / CSU parliamentary group, Dr. Jan-Marco Luczak, and the consumer protection officer of the CDU / CSU parliamentary group, Sebastian Steineke:

Dr. Jan-Marco Luczak: “Consumers have to be better protected against unfair contracts, which is why we take targeted action against excessively long notice periods and subsequent inappropriate contract extensions. However, it is also clear to us that we want to preserve the freedom of contract and give consumers the opportunity to conclude contracts according to their individual needs and to benefit from cost advantages. We have therefore enforced that the ban on contract periods of over one year demanded by the Federal Ministry of Justice is off the table. Because longer contract periods regularly offer consumers price advantages and loyalty discounts, because companies then have investment security and can calculate prices better. Consumers will be able to decide freely in the future whether they want to commit themselves in the long term, but at low cost, or whether they prefer greater flexibility and a higher price. The current draft law, in which one-year contracts are only permitted with a price premium of a maximum of 25 percent over two-year contracts, is a compromise that we will look at very critically in the further parliamentary procedure. “

Sebastian Steineke: “With the planned exclusion of assignment bans in general terms and conditions (GTC), the draft takes up a central union requirement that we agreed in the coalition agreement. Furthermore, we generally welcome new regulations to protect against contracts that have been postponed by telephone. The statutory reduction in contract terms initially envisaged by Minister Lambrecht met with a lot of criticism not only from the companies concerned. It was also viewed with skepticism among consumers. It is good that the other important goals of the law did not fail at this point and can now be implemented in this legislative period. “
