Orsk interdistrict environmental prosecutor of the Orenburg region, based on the results of an audit of the implementation of the legislation on subsoil use, initiated an administrative offense case against the municipal unitary enterprise “Housing and Communal Services” under Part 1 of Art. 7.3 of the Administrative Code of the Russian Federation (use of subsoil without a license).

It has been established that since 2003 the enterprise, in accordance with the issued license, has been producing groundwater at the Gayskoye deposit to provide water supply to the population and enterprises of the city of Gaya, Orenburg region. Since January 2019, after the expiration of the permit, the extraction was carried out illegally. As a result, for 2019 – 8 months of 2020, the subsoil user illegally received about 4 million cubic meters of water resources.

Having considered the decision of the prosecutor, the South Ural interregional department of Rosprirodnadzor found the subsoil user guilty of committing an offense with the imposition of a fine in the amount of 800 thousand rubles.

After the appeal in court, the decision came into legal force.
