Do you have to move? Your notice period expires during containment? Wondering if the inventory of your new home will be possible? Are you looking for a new apartment? Can your general meeting of co-owners be held? Do you want to go to your future home to do some work? During this new confinement where contacts and movements are limited, a certain number of steps remain possible. Whether you are a tenant or an owner, Service-Public.fr explains what is allowed.

Move

During the entire confinement period, you can move out (by yourself or by a professional), sign your lease, hand over the keys and make an inventory.

A move by private individuals is authorized, but it must not involve more than 6 people maximum (moving people included). These people do not necessarily have to come from the same household or domicile.

Proof from the removal company, a deed of sale or your new lease can be used as proof.

Rental

Sign a rental contract

Online signing of a rental agreement is possible, provided that the signatories are identified and that the integrity of the document is guaranteed. Otherwise, travel remains possible. On the other hand, the act of surety cannot be entirely carried out electronically and requires sending by mail.

Carry out an entry or exit inventory

Real estate agents and individuals can carry out an entry or exit inventory. If one of the parties does not appear or if the parties do not agree on the contents of the inventory, the lessor or the tenant can call on a bailiff to establish it. The latter must notify the parties at least 7 days in advance by registered letter with acknowledgment of receipt. In this case, the bailiff’s costs are shared in half between the lessor and the tenant.

Expiration of notice period during confinement

After the notice period has expired, moves are possible. The premises must be vacated, unless the lessor and the tenant agree to put in place a temporary occupancy agreement, providing for the payment of an occupancy allowance.

Revision of rents

No text suspends the application of rent revision clauses contained in residential leases during confinement. Any rent is subject to review.

Rental eviction

The winter break is implemented as of November 1, 2020. Rental evictions cannot occur during confinement except in cases already provided for .

Social landlord activity

The rental missions of the lessors are public service missions maintained during the confinement. The applicants and tenants can carry out their inventory of fixtures, forecasts, appointment of signature of lease… Acts related to the move (inventory of places of exit and handing over of the keys) are possible. Applicants and tenants can therefore attend these meetings with a written notice from the lessor.

Purchase or rental: visits to new accommodation

Visits to homes before rental or sale by individuals are possible.

Pre-delivery visits for new homes

Pre-delivery visits are necessary to allow the finalization of the accommodations and the subsequent move. They are therefore authorized in the same way as removals and related operations.

Notary

The studies of notaries remain active. They set up remote signature systems as much as possible. When this is not possible, notaries can welcome the public, by appointment, in the studies.

Work in your home

Work in your current accommodation

The work and in particular the energy renovation work can be maintained while respecting barrier gestures. Craftsmen and individuals will take maximum precautions, in accordance with guide from the Professional Organization for the Prevention of Building and Public Works (OPPBTP) , by regularly ventilating the work area, for example.

The individual must accept the general conditions of intervention, in particular the specific conditions of hygiene and sanitary rules (ability to respect barrier gestures, minimum distance of 1 meter from any person, access to a water point for washing hands, access to hygiene facilities, wearing a mask).

Work carried out by you in a future accommodation

The case of work carried out by a private individual in his future accommodation is not listed among the exceptional reasons for travel: it is therefore not authorized to travel for this reason in general. Special cases may be assessed if this work responds to a pressing family reason: for example urgent work carried out by an individual to be able to move, to be able to integrate his future accommodation or home in the event of sale or notice to vacate his home or accommodation current.

Co-ownership

General meetings cannot be held face-to-face. They can take place by videoconference, by any other electronic means of communication allowing the identification of the co-owners and by postal vote until April 1, 2020.

Extension of the mandates of trustees

The trustee contracts as well as the terms of office of union council members expiring between October 29, 2020 and December 31, 2020 are extended until the trustee contracts and union council mandates voted at the general meeting come into effect. The latter must take place no later than January 31, 2021.

Interventions by professionals

Professionals are authorized to travel to carry out missions that cannot be teleworked, such as for example appraisals, works, diagnostics, renovations.

To travel to the notary, you can check the box “judicial or administrative summons and to go to a public service”.
