Mister President! Ladies and gentlemen! I am now of course tempted to say that there is nothing left to add to Mr Jung’s clever words.

Nevertheless, I would like to point out two things that are important to me.

If you look at the estimated extent of money laundering in Germany alone, then you have to refer to a study by the University of Halle from 2015. It names the unimaginable sum of 100 billion euros – almost a third of our federal budget. These 100 billion euros not only show the extent of the crime, but they also show the suffering that lies behind it, because behind every money laundering there is a predicate offense that we must combat in this constitutional state.

It is therefore right that we continue to work with this law to prevent money laundering. Precisely because the number and scope of predicate offenses is increasing, it is right that we dispense with the catalog of predicate offenses and thus allow every criminal offense as a predicate offense. I am also pleased that our request was successful and that the so-called frivolous money laundering, which practitioners say is the gateway, has now also found its way into the government draft from the ministerial draft.

What we still have to talk about is in fact the question of self-confiscation, Section 76a of the Criminal Code. This is a criminal law norm that you may not stumble upon immediately, but which is extremely important for the public prosecutor’s offices, namely when it comes to the question: How can I secure assets immediately if I may not yet know what exactly the predicate offense was? That is why we must not narrow down the predicate offense, but every initial suspicion must suffice to secure this money; because any money that is secured is taken out of the criminal cycle. That is why I think it is a very important momentum that we must look at very carefully in the course of the debate.

It is also important to me to emphasize that we need an awareness beyond the legal framework. We need good people at the LKAs and state prosecutors as well as at our Financial Intelligence Unit at the Customs Criminal Police Office and we have to be open to expelling jobs; because the state can only act well and safely if it has the appropriate personnel. We create the legal framework; but the state must also implement these regulations. Because there are other challenges that we have to face, for example the question of money laundering in the Bitcoin sector.

We declare war on criminal machinations and with this law we will push back money laundering in Germany. Let’s debate this well.
