Civil servants, contract agents within the State, hospital or regional civil service, in the event of your child’s alternate residence, the family treatment supplement (SFT) can now be shared by half between the 2 parents upon their joint request. If there is a disagreement, it can also be shared at the request of one of them. A decree published in the Official Journal on November 11, 2020 specifies the methods of implementation and calculation of this measure.

The family salary supplement (SFT) is paid to any public official, civil servant or contractual, who has at least one dependent child. The amount of SFT depends on the number of dependent children and the agent’s plus index.

Until then, when the parents separated or divorced, the SFT went to the one who was responsible for the children, with no possible sharing for the same child in the event of alternating residence.

From now on, in the event of alternate residence of the child at the home of each parent, the SFT can be shared by half between the two parents who are civil servants or contractual civil servants:

at the joint request of the parents. If you make a joint request for partition, you can only request a change to these payment conditions after one year, unless the child’s residence status changes.
at the request of one of them if the parents disagree.

Note: This provision is made in application of the law of 6 August 2019 on the transformation of the public service. It aims to adapt the public service to societal changes, in particular to the development of alternating childcare arrangements in the homes of both parents.

Calculation methods

The SFT owed to each parent is equal to the SFT calculated on the basis of all the children for which he is a parent or for whom he is responsible. But he is multiplied by a coefficient equal to the average number of his children divided by the total number of children for whom he is a parent or for whom he is responsible. The average number of children for each parent is obtained by adding the number of dependent children under the following conditions:

each child in alternating residence counts as 0.5;
other dependent children count as 1.

Example:

A couple had 2 children who are in joint custody.

The mother had 1 other child (so 3 in total) and the father had 2 other children with a woman who already had 1, who is also dependent on him (so 5 in total).

For the mother, the SFT is calculated on the basis of 3 children (€ 15.24 + 8% of her gross index salary) multiplied by 0.67 (2 x 0.5 + 1/3).

For the father, the SFT is calculated on the basis of 5 children (€ 15.24 + 2 x € 4.57 + 8% of his gross index salary + 2 x 6% of his gross index salary) multiplied by 0.8 (2 x 0.5 + 3 x 1/5).

You can request that your SFT be calculated on the basis of the index salary of your ex-spouse, if it is higher than yours.

In this case, your SFT is equal to the SFT calculated based on the number of children for which your ex-spouse is a parent or for whom he is responsible, multiplied by a coefficient equal to your average number of children divided by the total number of children for whom your ex-spouse is a parent or for whom he is responsible.

Example:

A couple had 2 children who are in joint custody.

The mother had 1 other child (so 3 in total) and the father had 2 other children with a woman who already had 1, who is also dependent on him (so 5 in total).

If the mother requests that her SFT be calculated on the basis of the index salary of her ex-spouse, her SFT will be calculated on the basis of 5 children (€ 15.24 + 2 x € 4.57 + 8% of the salary gross index of his ex-spouse + 2 x 6% of the gross index of salary of his ex-spouse) multiplied by 0.4 (2 x 0.5 + 1/5).
