Certain data collected as part of the system for monitoring patients and tracing contacts against the Covid-19 epidemic may be kept until April 1, 2021. This is data rendered non-identifying used for surveillance purposes epidemiological and virus research. A decree was published in the Official Journal of November 15, 2020 in application of the law of November 14, 2020 extending the state of health emergency. Update on the systems in place: SI-DEP (Integrated screening and prevention service) and Contact Covid.
What systems collect the data?
Governed by the decree of May 12, 2020, there are two systems where data is collected:
SI-DEP lists people by systematically recording the results of tests carried out by all the laboratories and structures authorized to carry out the diagnosis of Covid-19 (hospital laboratories, city medical biology laboratories, approved veterinary laboratories, etc. );
Contact Covid identifies “zero patients” (infected people) and “contact cases” (people with whom they have had contact).
Note: Initially authorized until January 10, 2021, these 2 systems are extended until April 1, 2021.
What data is in SI-DEP?
The data concerning those who have been tested for Covid-19 are as follows:
identification data: surname, first name, sex, date of birth, place of birth … or any other number allowing the patient to be identified with certainty;
situation data allowing agents to prioritize calls by degree of urgency: healthcare professional, residing in collective accommodation, hospitalized in a healthcare establishment, date of onset of my first symptoms;
patient details (mailing address, phone number, email);
the contact details of the responsible physicians;
the date and time of the sample and the results of the examination.
What data is in Contact Covid?
Recorded by general practitioners, health investigators from the National Health Insurance Fund (CNAM), Public Health France and Regional Health Agencies (ARS), data concerning “zero patients” and “contact cases” are in particular:
identification data (surnames, first names, date of birth, sex) and social security number and affiliation;
contact details and accommodation;
the contact details and the specialty of the doctor who initiated the registration in the data processing;
health data strictly limited to the virological or serological status of individuals and, where applicable, the existence of symptoms and the date of their onset;
data relating to the person’s situation at the time of their screening (hospitalized, at home or already in isolation);
the data necessary for carrying out health surveys to establish in particular transmission chains or “clusters” (occupation, attendance or not of a community such as a gathering of more than 10 people, a crèche, a school, an nursing home , a penitentiary establishment, a tourist accommodation structure… as well as the realization of a recent trip outside his region and his State of residence);
declaration of a need for social support and isolation support.
What protection of personal data?
Data collection ceases on April 1, 2021. After collection, the data is deleted after 3 months and does not feed into the Stop Covid application.
For epidemiological and research uses, the data is pseudonymized (deletion of surname, first name, etc.) in order to ensure the confidentiality of the identity of individuals. Made non-identifying, they can be kept until April 1, 2021. Their use is reserved for epidemiological surveillance at national and local levels in the treatments implemented by: the National Public Health Agency and the ARS, the management research, studies, evaluation and statistics from the Ministry of Solidarity and Health, the CNAM, the military health service.
CNAM employees responsible for identifying contact persons and calling them must apply strict instructions for informing the persons called on their rights in terms of data communication.
Only professionals bound by professional secrecy have access to the data: doctors who have prescribed the test or provide follow-up for people, employees and service providers strictly authorized by the CNAM, Public Health France and the ARS and occupational physicians.
Medical biology laboratories and pharmacists only have access to the identification and contact data of people in order to be able to carry out tests or dispense masks covered by Social Security.
The patient is free to communicate or not the information requested of him to stop the epidemic. With the exception of the contact details and the result of the sick patient’s test, which are essential to the very existence of the device, all of the other information collected in the system is collected on the basis of voluntary declarations from people positive for Covid- 19 and their contacts.
Disclosure of the identity of the infected patient to people with whom he has been in contact and who may be infected is only possible with his consent.
Individuals may object to the re-use of their data for studies or evaluations.
