The Prosecutor General’s Office of the Russian Federation has special control over issues related to the activities of stevedoring companies that transship coal in the seaports of Nakhodka – Nakhodka and Vostochny (12 organizations are transshipping at these two ports). The aggregate volume of their production activities does not, on average, exceed about 50 million tons per year.

The Prosecutor General’s Office of the Russian Federation, together with the Far Eastern Transport Prosecutor’s Office, has been working since 2018 to compel stevedoring companies to bring their activities in line with the requirements of the legislation on environmental protection, on the sanitary and epidemiological well-being of the population. Controlling their compliance with the current legislation, employees of the General Prosecutor’s Office of the Russian Federation periodically make visits to the Nakhodka urban district, hold receptions of citizens, and organize interagency cooperation. In particular, during the last trip at the end of October 2020, prosecutors, together with representatives of the Ministry of Transport of Russia, the Ministry of Natural Resources of Russia, with the participation of the Government of the Primorsky Territory, visited a kindergarten and a school located directly outside the boundaries of the sanitary protection zones of the enterprises of the seaport of Nakhodka.

As a result of the measures taken, stevedores additionally acquired dust suppression systems, dust collecting devices, snow generators, irrigation systems, gas analyzers, and specialized cleaning equipment. Storage areas for coal piles are equipped with retaining overall walls and dust and wind protection shields.

Following the response of the General Prosecutor’s Office of the Russian Federation, the Ministry of Transport of Russia amended the Rules for the provision of services for transshipment of goods in the seaport, consolidating the concept of “closed transshipment of coal”. These amendments are aimed at reducing emissions of pollutants and minimizing negative impact on the environment.

The results of recent inspections indicate the absence of systemic violations of the environmental rights of citizens, which is confirmed by the results of social and hygienic monitoring and control of the state of atmospheric air carried out by the control authorities in the indicated seaports (out of 1109 samples taken in 2020, 7 exceeding the maximum permissible concentrations of harmful (polluting) ) substances (in 2019 – 31)).

Despite the outlined tendency towards stabilization of the ecological and sanitary-epidemiological situation in the Nakhodka urban district, the prosecutor’s office still reveals certain violations. The issues of observance by stevedoring companies of the terms of agreements concluded with the federal executive authorities, the administration of the Primorsky Territory in order to ensure favorable conditions for the life and health of residents of Nakhodka require close attention. Not all enterprises received positive conclusions from the state environmental expertise. Some companies still fail to comply with environmental documentation requirements. Prosecutorial response measures are being taken on these facts. So, on November 3, the Nakhodka Transport Prosecutor sent 2 statements of claim to the court, in which he demanded from two stevedoring companies to equip conveyor belts of ship-loading machines and a retractable container with protective shelters, as well as to equip a warehouse of purified coal with a concrete retaining wall.

The Prosecutor General’s Office of the Russian Federation continues to implement a set of measures aimed at ensuring the rights of citizens to a favorable environment when handling coal in the seaports of Nakhodka.
