On behalf of the Prosecutor General of the Russian Federation Igor Krasnov, the prosecutor’s offices of the constituent entities of the Russian Federation carried out checks on the implementation of legislation in the field of operation of attraction equipment and the activities of private zoos.
Supervision activities were organized in connection with the increased incidence of injuries to children due to malfunctioning attractions and failure to ensure safety when keeping animals in zoos.
Prosecutorial inspections have revealed the facts of operation of attraction equipment that have not passed state registration and do not meet safety requirements. It was found that business entities – owners of amusement rides did not fulfill their obligations to properly maintain equipment, comply with fire safety rules and sanitary and epidemiological requirements, including those related to countering the spread of coronavirus infection. Often, when providing entertainment services, there was no mandatory information about the rules for using attractions.
The prosecutor’s office of the Udmurt Republic established such violations in the activities of 25 legal entities and individual entrepreneurs during the operation of 65 children’s attractions. In the city of Sevastopol, by the measures of the prosecutor’s response, the operation of 49 attractions that did not have documents on state registration were terminated.
In the Republic of Tatarstan, 44 attractions were operated in violation of the established safety requirements and without timely maintenance. Based on these facts, based on the materials of the prosecutor’s office, the investigative body has initiated and is investigating a criminal case on the provision of services that do not meet safety requirements. On the proposal of the prosecutor, the owner of the amusement rides organized their repair and maintenance. Also, on the initiative of the prosecutor’s office, a legal entity was brought to administrative responsibility by the court for violating the requirements of technical regulations in the form of a fine of 100 thousand rubles.
The state authorities of the constituent entities of the Russian Federation are entrusted with the implementation of regional state supervision in the field of the technical condition and operation of attractions. However, as established by the prosecutors, these powers were not always exercised properly, and there were no checks on compliance with the relevant requirements.
Only after the intervention of the prosecutor’s office in the Rostov region was the body authorized to exercise this supervision determined. The prosecutors of the republics of Crimea, Mordovia, Sevastopol, the Jewish Autonomous Region and other regions have taken response measures due to the lack of procedures for state registration of attractions.
Numerous violations of the law have also been identified in the area related to the activities of private zoos. In the Republics of Buryatia, Crimea, Altai, Primorsky Territories, Arkhangelsk, Kaluga, Nizhny Novgorod, Ryazan, Tula Regions and other regions, animals were kept in conditions that did not meet veterinary and antiepizootic requirements, and uncertified feed was used.
Prosecutorial inspections established cases when animals were placed in enclosures that did not meet regulatory requirements, they did not have proper safety barriers, gratings, nets between visitors and animals, as well as warning signs prohibiting them from approaching predators and feeding them. On such facts, acts of the prosecutor’s response have been introduced in the Krasnodar Territory, Amur, Bryansk, Voronezh, Kaliningrad, Leningrad, Moscow, Novgorod, Rostov and other regions.
Failure to comply with safety requirements during the operation of amusement rides and keeping animals often entailed injury to children, and in some cases their death. For example, according to the materials of the prosecutor’s check in the Sakhalin region, a criminal case was initiated on the fact of causing bodily harm to a minor in connection with an attack on him by a monkey.
