The prosecutor’s office of the Sovetskiy district of Tambov conducted an investigation on the complaint of a local resident about his disagreement with the actions of the housing construction cooperative “Senko 9A”, which did not return the share contribution paid for the completion of the apartment building.

It was established that in 2011 an agreement was signed between a citizen and a commercial organization for participation in the shared construction of a three-room apartment. However, in July 2014, the developer was declared bankrupt and bankruptcy proceedings were opened against him. The rights to complete the facility were transferred to the housing construction cooperative “Senko 9A” with the formation of share contributions from all members.

After the applicant left the cooperative, the return of the share contribution was refused.

In order to protect the rights of a citizen, the prosecutor of the Sovetsky district of Tambov sent a statement of claim to the court against the housing cooperative “Senko 9A” about the obligation to pay the former participant of the cooperative a share contribution of about 600 thousand rubles.

The court satisfied the prosecutor’s demands, and the applicant’s funds have now been fully paid.
