The Prosecutor’s Office of the Ust-Maisky District of the Republic of Sakha (Yakutia) carried out an audit of the implementation of the legislation in the provision of living quarters to orphans.
It was established that the administration of the municipal district “Ust-Mayskiy ulus (district)”, under lease agreements, transferred living quarters in an apartment building to 12 orphans.
According to the results of a survey by a specialized organization, the technical condition of the building structures of the apartment building was assessed as emergency. Due to the inadequate quality of the work performed, damage was formed in the form of destruction and deformation of the outer metal sheathing, support nodes for metal beams, displacement of beams from the design position of the floor, etc. The survey also revealed the facts of non-fulfillment in full of the work stipulated by the estimate documentation.
The deed of transfer under the municipal contract for the acquisition of these residential premises was signed by officials of the district administration without any comments.
The materials of the check were sent to the investigative body to resolve the issue of criminal prosecution. Based on the results of their consideration, a criminal case was initiated on the grounds of corpus delicti under Part 1 of Art. 293 of the Criminal Code of the Russian Federation (negligence).
The investigation of the criminal case is under the control of the prosecutor’s office of the Ust-Maisky district of the Republic of Sakha (Yakutia).
In addition, the district prosecutor’s office, in the interests of the orphans, applied to the court with statements of claim to impose on the administration of the municipal district “Ust-Mayskiy ulus (district)” the obligation to provide them with other living quarters of adequate quality that meet safety requirements. The claims are pending.
