Oleg Melnichenko Melnichenko Oleg Vladimirovich, Chairman of the Federation Council Committee on Federal Structure, Regional Policy, Local Self-Government and Northern Affairs, Oleg Vladimirovich, representative of the legislative (representative) state authority of the Penza Region, said that a draft law was developed and submitted to the State Duma to clarify the concept of “individual Housing construction. ”The authors of the bill are Federation Council members Oleg Melnichenko, Alexei Mayorov Mayorov Aleksey Petrovich representative of the legislative (representative) government body of the Republic of Kalmykia, Alexey Dmitrienko Dmitrienko Aleksey Gennadievich representative of the executive government body of the Penza region, Vyacheslav Timchenko Timur Representative (legislative body) State authority of the Kirov region, Andrey Shevchenko Shevchenko Andrey Anatolyevich representative of the legislative (representative) state authority of the Kemerovo region – Kuzbass. According to Oleg Melnichenko, in the regions, citizens are faced with the problem of ambiguous interpretation of the concept of “individual housing construction.” the definition provided by the Town Planning Code, it follows that the object of individual housing construction should have no more than three above ground floors. At the same time, the code does not establish which specific floors are above ground. The regulatory and technical documents that directly establish the requirements for individual residential buildings also lack a definition of an elevated floor. As a result, in practice, the concepts of “total number of floors”, “number of storeys”, “number of elevated floors” are mixed. This is especially vividly illustrated by the example of individual houses with a basement, which is often taken into account when calculating floors in an individual housing project as above-ground, ”the senator explained. The bill proposes to clarify the definition of an individual housing construction as provided for in paragraph 1 of Article 1 of the Town Planning Code of the Russian Federation, indicating that the ground floor is the floor with the floor mark of the premises not lower than the planning level of the earth.
