With regard to the internal borders with Austria, Switzerland, France, Luxembourg and Denmark, the German Federal Government has now given instructions that, with immediate effect, travellers without a valid reason to travel may no longer enter or leave Germany. Only German nationals, persons with resident status and persons whose principal residence is in Germany may continue to enter Germany without a ‘valid reason’.

1. Is this temporary blanket ban on entering and leaving Germany ‘without a valid reason’ formally and substantively compatible with Union law (e.g. Article 49 TFEU and Article 45 of the Charter of Fundamental Rights)?

2. What steps is the Commission taking to enforce the right, under Union law, to freedom of establishment, freedom of movement and freedom of residence?
