Modernizing the use of the tax exemption and improving the regulation of the training and employment system, in order to encourage its quality and relevance, is the purpose of the project (bulletin 12487) approved today by the Chamber of Deputies and sent to the Senate for second processing. .

The proposal was approved in general by means of two votes, one that ratified, by 139 votes in favor and five abstentions, the general rules; and another that supported the quorum provisions, by 143 votes in favor and one abstention.

Then, through thirteen votes, the articles were sanctioned, and the bulk of this was approved, except for a rule that allowed legal entities whose corporate purpose is both training and labor intermediation to operate as Otec.

The initiative modifies the application rules of the tax exemption and strengthens the copayment. In this framework, new limits of tax discounts are established for the conduct of training programs; procedures and conditions are defined to make the benefit effective; and the contributions that companies must incur are established.

Likewise, it is determined that only the expenses that have been incurred in financing actions and training programs actually carried out and liquidated or in solving the administrative expenses that the organization of such actions or programs may be subject to the franchise.

In addition, along with incorporating mechanisms that allow training for employment to be articulated with formal education, the execution of training actions carried out directly by the Training and Employment Service (Sence) is modernized and strengthened, adding modalities that allow civil society present training projects; the competences of the Service are strengthened; and the regulation on administrative sanctions is improved.

Strengthening the system

In addition, there is a strengthening and expansion of the actions and beneficiaries of the Training and Employment System; the concept of training is modified; and new functions are incorporated into the Technical Training Organizations (Otec), as well as an increase in the requirements for course enrollment.

In the case of the Otec, a restriction is also imposed to carry out training actions or provide services in this area to related companies, if they are not constituted as non-profit legal persons; and improvements are made to the National Registry of Technical Training Organizations administered by Sence

The proposal, additionally, allows companies, under the tax exemption, to carry out training actions, both with respect to their workers, as well as those who participate in other companies that provide them with goods or services or that provide services under subcontracting or transitory services, whether related or not, as long as they qualify as smaller companies.

In line with the above, the bill strengthens the National Training Fund and the powers of Sence, to ensure compliance with the law and the obligations of companies and technical bodies. In addition, it creates the Public Competitive Fund for training and modifies the regulatory framework that regulates the applicable infractions and sanctions.
