Want to create an association? But can you fix the seat of this association at home?

Yes answers Service-public.fr, the seat of an association may be the domicile of one of its members (owner or tenant of his home).

If you own

The seat of an association can be set at home as the owner of your home.

In a co-ownership, this domiciliation must not however affect the rights of other co-owners, or the destination of the building. It must respect the rules of co-ownership, in particular the rules on the use of private parts and common parts but also the rules concerning neighborhood disturbances.

Beware, if this domiciliation entails the exercise of an effective associative activity, you must obtain the agreement of all the co-owners.

If you are a tenant

The seat of an association can be attached to your home as a tenant.

However, this domiciliation must not lead to a breach of your obligations vis-à-vis your lessor and other tenants (in a building) or neighbors: noise in case of meetings, irregular occupation of common parts …

The dwelling must also remain your place of residence.
