It is the verbalizing agent who appreciates whether the tinted windows of a vehicle are sufficiently transparent and comply with the regulations. This is recalled by a decision of the Court of Cassation of November 13, 2018.

A motorist who had affixed a black film on the front side windows of his car, was prosecuted for violating the regulations on the transparency of the windows of a vehicle. The windshield and the front side windows must indeed have sufficient transparency and transmit at least 70% of the light.

The police court had relaxed it considering that no objective element resulted from the findings made by the police, to characterize the percentage of light transmitted.

But the judgment is broken. The Court of Cassation first recalled that the minutes of officers or judicial police officers are authentic until proven otherwise. It then held that the proof of the offense was established by the mere finding by the enforcement officer. It was indeed not able to distinguish the driver in his cockpit during the check.
