The warehouse owner raised a wall at the edge of his property and used it as the exterior wall of a new building.
The neighboring owner argued that the wall was semi-detached. He had asked for compensation for his injuries.
The Court of Appeal had acceded to his request considering that the elevation of the wall thus completed implied half on his property.
The Court of Cassation breaks the judgment after having recalled the principle according to which any owner can make raise a wall dividing.
Indeed according to the civil code, the co-owner of a party wall can raise it privately, subject to bear the cost of its construction and maintenance.
