The prosecutor’s office of the Tuzhinsky district of the Kirov region carried out an audit of compliance with the anti-corruption legislation in Drive LLC, whose activities are related to the provision of taxi services.
It was established that in March 2018 a former DPS inspector was employed in the company without a proper notification to the Ministry of Internal Affairs of Russia in the Kirov region about the hiring of a former police officer.
In accordance with the current legislation “On Combating Corruption”, the employer, when concluding an employment or civil law contract for the performance of work with a citizen who replaces a state or municipal service, is obliged to notify the employer of a state or municipal employee of the last place within 10 days his service. Failure to comply with this obligation by the employer is an offense and leads to liability in accordance with the legislation of the Russian Federation (Article 19.29 of the Code of Administrative Offenses of the Russian Federation), while the limitation period for bringing to administrative responsibility is 6 years.
On this fact, the district prosecutor’s office initiated proceedings against the head of a commercial company in the case of an administrative violation under Art. 19.29 of the Administrative Code of the Russian Federation (unlawfully recruiting or performing work or providing services to a state or municipal employee or a former state or municipal employee), which was reviewed with the appointment of an official penalty in the form of a fine of 20 thousand rubles.
The court’s decision did not come into force.
